The Labor & Employment Group of Fowler White provides complete general employment advice and litigation services to private and public sector clients including all aspects of labor and employment relations.

The Labor & Employment Group is committed to advising employers on methods to avoid workplace disputes and assisting our clients in complying with federal, state and local laws on discrimination. To effectively avoid litigation in the first place, Fowler White attorneys in this group prepare corporate policies in the following areas: sexual and other workplace harassment, wage and hour laws, drug and alcohol testing, protection against workplace violence and use of technology and the Internet in the workplace.

The Labor & Employment Group advises clients in the following areas: compliance with the laws on employee background checks, creation of employment applications, performance appraisals, warning and disciplinary notices, the rights and obligations of an employer with respect to compensation and benefits programs, and agreements concerning competition and solicitation following termination.

Fowler White has tremendous experience in litigating employment discrimination claims before federal, state and appellate courts as well as administrative agencies. See O'Connor v. PCA Family Health Plan, Inc., 200 F.3d 1349 (11th Cir. 2000)(affirming defense verdict in FMLA trial); Robertson v. Home Depot, 976 F. Supp. 1467 (S.D. Fla. 1997)(awarding summary judgment on a race and national origin claim), aff'd, 149 F.3d 1195 (11th Cir. 1998).

In addition to its regular appearances in federal court, the Labor & Employment Group represents employers in state court in matters involving: retaliatory discharge under the Florida Workers' Compensation Act, breach of contract, alleged violation of the Florida Whistle blower's statute and alleged violation of the Florida Civil Rights Act (Florida's equivalent of Title VII).

Fowler White has extensively litigated the enforceability of non-competition and non-solicitation agreements, as well as the meaning and scope of common law and statutory provisions pertaining to confidential information and trade secrets.

Fowler White's Labor & Employment Law Group represents employers at the administrative level before the Equal Employment Opportunity Commission, the Florida Human Rights Commission, Miami-Dade County Equal Opportunity Board, the National Labor Relations Board, the U.S. Department of Labor, the Division of Occupational Safety and Health as well as various other state and local agencies charged with enforcing employment and labor laws.

In labor matters, the Labor & Employment Law Group represents management in all aspects of labor related issues in the workplace including: advising management on union avoidance, assisting with election campaigns, representing management with respect to unfair labor practice charges and representing management at grievance proceedings.
