Morris Pataky’s practice involves the litigation of bad faith insurance disputes and insurance coverage actions, as well as real estate and commercial contract actions.
His extensive experience with the defense of insurance carriers in bad faith disputes includes consulting and defending primary and excess carriers against these claims. Morris has advised carriers and handled more than 50 cases involving multiple claimants and limited insurance proceeds.
Morris also regularly handles insurance coverage litigation which involves the evaluation and defense of coverage disputes on behalf of insurance companies. He has also defended numerous foreclosures and title defect claims for mortgage companies throughout South Florida.
Throughout his career, Morris has also defended dentists and emergency medicine physicians in malpractice actions. Specifically, Morris has worked with dentists in the defense of claims brought by individuals and the Florida Department of Health.
Representative Matters
Represented a business owner in a successful action that forced two other partners to sell a jointly owned building to the client at a previously contracted price.
Defended an insurance carrier in a bad faith trial brought by a third party whose claim was not settled at a pre-suit mediation with multiple claimants.
Participated in the defense of an insurance carrier from a first party bad faith claim stemming from a failure to pay policy proceeds owed when prior counsel admitted in court documents that a previous amount paid by the carrier was not the correct amount owed under the applicable policy.
